I am in the process of installing ScummVM on my Iphone 4. I will post more if I run into problems or once I get it running!!

I have a few games installed and all seems to be running fine with no hitches. I changed the icon to a higher res one via the ipad instructions. The new icon is there but i had to install another app via cydia to get it to refresh. this is no biggie. A reset of the phone didn't do it

Jailbreaking was recently ruled legally exempt from the DMCA.

Nope but most countries have laws that allow you to make modifications to the hardware you have bought freely.
